First, I'm using W98SE. I'm posting here because I think this may help someone.
I had a similar problem -- non-allocatable space file, zero bytes, etc. I got rid
of it by right-clicking on the "InCD" icon in the system tray, and selecting "Options".
Put a check in the "MRW Format all drives". Click "Apply". Now, take one of those
disks with the "non-allocatable space" files in your drive, and use InCD to format
it. Make sure the "MRW Format all drives" is still selected. You will get a popup
about two minutes into the process that says "format completed", or something similar.
Ignore it, and wait until all the lights stop flashing on the CD. Eject the disk,
put the disk back in, and check it out. Hopefully, the disk will be empty. Note
that not all drives support the "Mount Rainier Format". I have no answer for that.
But, this worked for me. My version of InCD is 4.0.1.0. For more about the Mount

Do you really have to wait until the lights stop flashing, or could you quit when
the popup says "format complete"? Don't know, haven't tested it, but again -- this
worked, after weeks of copying from a CD-R/W, using xcopy32, and having it fail when
it ran across the "non-allocatable space" file.
Note that I did test the above as follows:
Format without Mount Rainier: Result, the hated file is generated.
Format with Mount Rainier: Result, no hated file.
Re-format without Mount Rainier: It's back.
Format with Mount Rainier: It's out of the building.
