40GB HD Missing 15 GB of of Space

XP INFO

A 40 GB hdd should give 37.25 GB of Binary space. Is it an OEM drive and does it have a hidden recovery partition? (Usually about 5 GB). I have seen a 250 GB drive with a 15GB recovery partition which has only about 5 GB of actual recovery files in the form of a 'Ghost' drive image and 10 GB of wasted space. System Restore is the usual culprit after which it might be the MFT. How is the drive formatted?
