Fixed, after spending countless hours reading forums going through my system looking
for a debugger i found my problem. the debugger had to do with my soundcard and soundcard
gameport controler. go to control panel, system, hardware, device manager, find sound/audio
and right click on audio device and disable, also click on gameport device under
sound/audio and disable. restart and try to launch game if it now works enable soundcard
and restart.
